COMPARISON STUDY OF THE ROLE OF NOTARY IN THE PERSPECTIVE OF ISLAMIC LAW AND POSITIVE LAW IN RELATIONSHIP WITH SERVICE TO THE COMMUNITY

Abstract

This Research aims to identify and explain the role of the notary in the perspective of Islamic law and positive law and at the same time analyze the comparison of the two perspectives in relation to service to the community. This study uses a normative juridical approach.

In carrying out his role in society, a Notary Public must act professionally based on a noble personality by always implementing the law while upholding the Code of Ethics for his profession. A notary is expected to be able to act honestly, thoroughly, independently, and to protect the interests of the parties involved in legal actions. In addition, Notaries as public officials must be able to follow legal developments so that in providing their services to the community, in helping to overcome and meet the growing legal needs, they can provide solutions justified by law.
