Implementation of Diversion towards Child Perpetrators of the Crime of Beating in the Concept of Justice
Abstract
This study aims to determine and analyze the implementation of diversion against children who are perpetrators of the crime of beatings in the concept of justice at the Semarang Police Station and the effectiveness of the application of diversion to children who are perpetrators of the crime of beating the Semarang Police. The approach method used is sociological juridical, descriptive analytical research specifications. The data used are primary data and secondary data. Data collection methods are field studies and literature studies. The data analysis method used qualitative analysis. The theory used in this research is the theory of law enforcement and the theory of justice. The results showed that the implementation of diversion against children who were perpetrators of the crime of beatings in the concept of justice at the Semarang Police was in accordance with the provisions of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The diversion process involves all, namely the victim's family, the perpetrator's family, and the Fathers, namely through deliberation involving the child and his/her parents/guardians, the victim and/or their parents/guardians, community counselors, based on a restorative justice approach. The application of diversion to children who are perpetrators of criminal acts at the Semarang Police is very effective in resolving the crime of beating children with child offenders. Through diversion, the case settlement procedure becomes simpler, cheaper and saves time. The implementation of diversion is also able to reduce the accumulation of cases handled at the Semarang Police Station, reducing the cost burden.
