Police Responsibilities in Security Using Tear Gas are Related to the Protection of Children

Abstract


This research is an answer to this problem. This type of research is field research, using sociological juridical analysis methods, meaning that the type of research used is legal research originating from legislation and approaches related to social theory. The theories used in this research are the Legal Certainty theory from Gustav Radbruch and the legal protection theory from Christine S.T.Kansil. Referring to the National Police Chief's regulation No.Pol 16 of 2006 concerning crowd control guidelines, instructions for security activities are prepared, training is carried out for personnel appointed to fire tear gas, checks are carried out on the expiry date of the tear gas to be used, and warnings are sought. calm or conducive conditions (building communication to avoid more aggressive security efforts). Children are not permitted to be in crowds or in areas that endanger the physical safety of children, however, if there are conditions where it turns out that there are children in vulnerable or dangerous areas then the appeal is a priority. It is hoped that the role of DP3AP2KB in providing advocacy and community outreach can support efforts to prevent and overcome the protection of children from participating in violence, and securing crowds who are forced to use tear gas must comply with the Police SOP. The main objective in this protective role is to ensure that the use of tear gas is carried out in a manner that complies with ethical and human rights standards, and to minimize the risk of injury to all parties involved.
