Legal Legitimacy of Police Authority to Investigate Corruption Crimes
Abstract
The aim of this research is to examine and analyze the authority of the Police to carry out judicial investigations of criminal acts of corruption. In this writing the author uses a normative juridical method with research specifications in the form of descriptive analysis. In law enforcement for criminal acts of corruption, the law enforcement agency, namely the National Police, also plays a role in implementing law enforcement against these extraordinary crimes. The role of the National Police as investigators in the criminal justice system for criminal acts of corruption is essentially a functionalization of criminal law, meaning that functionalization plays an important role in law enforcement. Juridically, the legal legitimacy of police authority in investigating criminal acts of corruption is found in various laws and regulations including: Law No. 8 of 1981 concerning the Criminal Procedure Code, which explains that investigators are State Police Officials of the Republic of Indonesia, and Law no. 31 of 1999 concerning Corruption Crimes as amended by Law no. 20 of 2001 concerning Amendments to Law no. 31 of 1999.
