Overview of Criminal Aspects in the Oil and Gas Sector

Abstract


The aim of this research is to find out, study and analyze forms of criminal acts in the oil and gas sector. In this writing the author uses a normative juridical method with research specifications in the form of descriptive analysis. Oil and Natural Gas are one of the greatest natural resources owned by Indonesia. Indonesian mining produces oil and natural gas which are strategic natural resources that are renewable (exhausted) and are vital commodities that affect the lives of many people. The widespread actions of some communities to explore and exploit oil and natural gas without a business permit is actually an act that is against the law. This is because almost all petroleum transporters do not have business permits. Law Number 22 of 2001 concerning Oil and Natural Gas identifies the types of criminal acts that will be imposed on perpetrators who commit crimes in the Oil and Gas sector. The forms of criminal action regulated in Law 22 of 2001 are processing without a processing business permit;            Transportation without a transportation business permit; Storage without a storage business permit; Trading without a commercial business license.
