Legal Protection Of Children As Criminal Offenders Of Narcotics Abuse

Abstract


The spread of narcotics in Indonesia is quite widespread. The impact of this spread is mostly detrimental to teenagers and children who are still underage. What we don't realize is that this act is prohibited by law according to Law Number 35 of 2009 concerning Narcotics. The effects caused by narcotics are very significant for both individuals and society. This research aims to research and analyze legal protection for children as perpetrators of criminal acts of narcotics abuse from the legal perspective of protecting minors.  The approach method used by the author in this thesis research is a normative juridical approach method, namely by using a statutory approach as a basic basis for research and analyzing based on library study materials as well as literature and other scientific works. The results of the thesis research discussion are the role of parents and environmental factors that can trigger the behavior of a child to commit criminal acts of narcotics abuse. Then, if a criminal act of narcotics abuse has occurred by a child, the judge will provide legal protection. The form of legal protection provided is as regulated in Law Number 11 of 2012 concerning the Juvenile Justice System by prioritizing the Diversion policy by replacing imprisonment with a period of training and community service. Then determine sanctions for the child/defendant in accordance with Article 82 of the Juvenile Criminal Justice System Law.
