Comparison of the Development of the Criminal Punishment of Castration in Various Countries and Indonesia

Abstract


The aim of this research is to determine and analyze the implementation of the castration penalty in various countries and the politics of castration criminal law in Indonesia. In this writing the author uses a normative juridical method with research specifications in the form of descriptive analysis. Castration has existed in Europe since the Middle Ages. In a number of countries, castration is the punishment for sexual criminals, both rapists and pedophiles. In several countries the practice of castration has been implemented as a special punishment. Each method has different physical and psychological effects. In some countries, castration has been in effect for a long time. One of them is in the United States, which is a developed country. However, the castration penalty has not been implemented in all US states, but only in nine states. In the United States states such as Louisiana and Iowa have adopted castration as a treatment and not a punishment. Injecting chemical fluids into perpetrators of sexual crimes against children in the form of medroxy progesterone acetate (MPA) is believed to reduce testosterone levels which has implications for decreasing sexual desire.
