Legal Protection for Alleged Medical Malpractice Crimes Based on Justice Values

Abstract


The aim of this research is to analyze and find current legal protection for alleged criminal acts of medical malpractice. To analyze and find weaknesses in the current legal protection for alleged criminal acts of medical malpractice. To analyze and find solutions for legal protection of alleged criminal acts of medical malpractice based on the value of justice. This research is a type of normative juridical research with a conceptual approach and data analysis methods carried out by collecting data through reviewing library materials or secondary data which includes primary legal materials, secondary legal materials and tertiary legal materials, both in the form of documents and regulations. applicable legislation relating to normative juridical analysis. The results of this research are that legal protection for alleged criminal acts of medical malpractice against patients is regulated in the Criminal Code, Law no. 1 of 2023 concerning the Criminal Code, Law Number 17 of 2023 concerning Health, Code of Ethics for the Indonesian Medical Profession. to create justice for the parties in the future, the medical dispute resolution model is through the Medical Dispute Resolution Institute. Weaknesses in legal protection for alleged criminal acts of medical malpractice are currently divided into weaknesses in legal substance, namely the lack of clarity regarding the meaning of medical malpractice as contained in the Criminal Code and Law no. 1 of 2023 concerning the Criminal Code and Law Number 17 of 2023 concerning Health. The weakness of the legal structure that occurs is that enforcement by law enforcement officers is in practice equated with regulating criminal wrongdoing. Weaknesses in legal culture include the weakness of health workers who do not carry out their work professionally and the public's lack of understanding about the science of medical malpractice. Solutions for legal protection of alleged criminal acts of medical malpractice based on the value of justice will be a model for resolving medical disputes through the Medical Dispute Resolution Institute.
