Legal Protection by Advocates for the Rights of suspects in the Investigation Process of Criminal Cases

Abstract


One of the obstacles in law enforcement is that there is still arbitrary treatment by law enforcement officers towards someone who is a suspect or defendant in a criminal case process. Even violations of their human rights, as well as the principle of presumption of innocence. The emergence of this arbitrary treatment can generally be said to be the result of the public's lack of awareness and knowledge of the laws that apply in our country, especially regarding the provisions of the law that regulate their rights and on the other hand these conditions used by law enforcement officials in carrying out the process of investigations (arrest and detention) and trials that deviate from the provisions of applicable laws and regulations. One of the suspect's rights is to obtain legal assistance especially for those who do not understand the law, even for those with middle to lower social status. A person's weak position and incompetence should not prevent that person from obtaining justice. Providing legal assistance to perpetrators of criminal acts without discrimination is a form of protection and equal treatment before the law. Without legal assistance for perpetrators of criminal acts, equality before the law as mandated by the constitution and universal values of human rights will never be fulfilled.
